{"id":72775,"date":"2026-07-24T13:35:26","date_gmt":"2026-07-24T08:05:26","guid":{"rendered":"https:\/\/mint-money.in\/index.php\/2026\/07\/24\/cci-cracks-down-on-hp-india-cartel-21-resellers-named-for-bid-rigging-and-gem-tender-manipulation\/"},"modified":"2026-07-24T13:35:26","modified_gmt":"2026-07-24T08:05:26","slug":"cci-cracks-down-on-hp-india-cartel-21-resellers-named-for-bid-rigging-and-gem-tender-manipulation","status":"publish","type":"post","link":"https:\/\/mint-money.in\/index.php\/2026\/07\/24\/cci-cracks-down-on-hp-india-cartel-21-resellers-named-for-bid-rigging-and-gem-tender-manipulation\/","title":{"rendered":"CCI Cracks Down on HP India Cartel; 21 Resellers Named for Bid-Rigging and GeM Tender Manipulation"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><strong>New Delhi [India], July 23:<\/strong> <strong>In a major action against cartelisation in government procurement,<\/strong> the <strong><em>Competition Commission of India (CCI)<\/em><\/strong> has imposed <strong><em>penalties exceeding \u20b9140 crore<\/em><\/strong> on <strong><em>HP India and 21 of its authorised resellers<\/em><\/strong> for indulging in <strong><em>anti-competitive practices, including bid-rigging, price coordination, cover bidding and manipulation of Government e-Marketplace (GeM) tenders.<\/em><\/strong><\/p>\n<p class=\"wp-block-paragraph\">The Commission found that <strong><em>HP India played a central role in orchestrating the cartel<\/em><\/strong> by dictating bid prices to its resellers and selectively issuing or withholding tender authorisations to influence which reseller would participate in a GeM tender. According to the CCI, this practice <strong><em>distorted competition, manipulated public procurement and created only an illusion of competitive bidding.<\/em><\/strong><\/p>\n<p class=\"wp-block-paragraph\">In the first case relating to the supply of <strong><em>personal system products<\/em><\/strong>, the CCI held <strong><em>Delphi Infosolutions, Digitech Computers, Orbit Techsol, Hind Technocare and Krishna Computers<\/em><\/strong> guilty of acting in collusion with HP India. The Commission found that these resellers <strong><em>coordinated bid submissions and pricing with HP India instead of competing independently<\/em><\/strong>, thereby violating the provisions of the Competition Act relating to <strong><em>cartelisation and bid-rigging.<\/em><\/strong><\/p>\n<p class=\"wp-block-paragraph\">In a separate order concerning the supply of <strong><em>HP toner cartridges, printer consumables and other supplies<\/em><\/strong>, the CCI named <strong><em>16 Tier-2 resellers<\/em><\/strong> for submitting <strong><em>support or cover bids<\/em><\/strong>\u2014a practice in which bidders deliberately submit non-competitive quotations to ensure that a pre-selected bidder secures the contract. The entities identified are:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong><em>DD Enterprises<\/em><\/strong><\/li>\n<li><strong><em>Ascent Information<\/em><\/strong><\/li>\n<li><strong><em>Kaypee Enterprises<\/em><\/strong><\/li>\n<li><strong><em>Britex Enterprises<\/em><\/strong><\/li>\n<li><strong><em>Alankar Distributors<\/em><\/strong><\/li>\n<li><strong><em>Vijay Stationery Mart<\/em><\/strong><\/li>\n<li><strong><em>G R Enterprises<\/em><\/strong><\/li>\n<li><strong><em>Perfect Innovative<\/em><\/strong><\/li>\n<li><strong><em>Khandelwal Traders<\/em><\/strong><\/li>\n<li><strong><em>A Square Technologies<\/em><\/strong><\/li>\n<li><strong><em>Innovative Solutions<\/em><\/strong><\/li>\n<li><strong><em>Pioneer Technologies<\/em><\/strong><\/li>\n<li><strong><em>Delphi Infosolutions<\/em><\/strong><\/li>\n<li><strong><em>Shakti Marketing<\/em><\/strong><\/li>\n<li><strong><em>International Computer Resources<\/em><\/strong><\/li>\n<li><strong><em>Arms Peripherals<\/em><\/strong><\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">The Commission observed that these firms participated in <strong><em>a coordinated arrangement facilitated by HP India<\/em><\/strong>, thereby <strong><em>undermining fair competition in government procurement and defeating the objective of transparent bidding through the GeM platform.<\/em><\/strong><\/p>\n<p class=\"wp-block-paragraph\">For the <strong><em>personal systems cartel<\/em><\/strong>, the CCI imposed <strong><em>a penalty of \u20b9126.87 crore on HP India<\/em><\/strong> and <strong><em>approximately \u20b91.22 crore collectively on the five resellers.<\/em><\/strong> In the <strong><em>consumables cartel<\/em><\/strong>, HP India was fined <strong><em>\u20b911.98 crore<\/em><\/strong>, while the <strong><em>16 resellers were collectively penalised about \u20b92.30 crore.<\/em><\/strong><\/p>\n<p class=\"wp-block-paragraph\">Besides imposing monetary penalties, the Commission directed <strong><em>HP India and all the concerned resellers<\/em><\/strong> to <strong><em>immediately cease and desist from anti-competitive practices.<\/em><\/strong> It also held the <strong><em>responsible officials of HP India and the reseller companies personally liable under Section 48 of the Competition Act<\/em><\/strong>, imposing separate monetary penalties on them.<\/p>\n<p class=\"wp-block-paragraph\">The CCI concluded that the conduct of <strong><em>HP India and its reseller network<\/em><\/strong> amounted to <strong><em>cartelisation, bid-rigging, cover bidding, price coordination and manipulation of GeM tenders<\/em><\/strong>, in violation of <strong><em>Sections 3(3)(d) read with Section 3(1) of the Competition Act, 2002.<\/em><\/strong> The order is expected to <strong><em>strengthen oversight of public procurement<\/em><\/strong> and serves as <strong><em>a strong warning that collusive bidding and manipulation of government tenders will invite stringent regulatory action.<\/em><\/strong><\/p>\n<p class=\"wp-block-paragraph\"><em>If you object to the content of this press release, please notify us at pr.error.rectification@gmail.com.
